Subject: Human Rights Policies and Guidelines
Asian Marine Services Public Company Limited and its subsidiaries adhere to the organizational philosophy that “People are the heart of driving the organization.” Therefore, employees are valuable resources and are essential to propelling the Company towards success and sustainable growth. The Company emphasizes caring for and treating employees and all stakeholders across its business value chain fairly, based on respect for human rights. It emphasizes fostering participation and valuing diversity to empower employees and inspire them to reach their full potential.
In this regard, the Company’s human rights policies have been established in compliance with international human rights guidelines and standards, including the United Nations Universal Declaration of Human Rights (UNDHR) and the International Labor Organization (ILO) Declaration on Fundamental Principles and Rights at Work, as well as the labor laws of the countries where the Company operates, internationally recognized standards upheld by the Company, the Company’s internal management policies, and customer requirements.
Scope
These policies apply to the business operations of Asian Marine Services Public Company Limited, its head office, the Surat Thani branch office, and its subsidiaries, to ensure the Company’s operations are free from human rights violations throughout its value chain and among its business partners, in accordance with international legal principles.
Definitions
The Company refers to Asian Marine Services Public Company Limited.
Subsidiary refers to affiliated companies of the Asian Marine Services Public Company Limited.
Employees refers to all levels of employees and workers at the Company.
Business partners refer to suppliers of goods and services, including labor and service contractors.
Child labor refers to work performed by individuals under the age of 18, but above the minimum age for employment.
Forced labor refers to work that a person performs unwillingly, under the use of coercion or other forms of compulsion.
Punishment refers to coercion, intimidation, or compulsion to work or provide services against their will, or placing them in a state where they are unable to resist.
Guidelines
1. The Company recognizes and respects the human rights of all employees and stakeholders involved in its business operations. All parties shall treat one another with mutual respect, honor, and equality across all dimensions of thought and perspective—including race, color, religion, gender, nationality, age, disability, or any other status—without discrimination.
2. The Company will execute its duties with due care and will not participate in any actions that violate human rights, especially forced labor, illegal migrant labor, child labor, human trafficking, unfair remuneration, discrimination, and violations of personal data rights.
3. The Company will treat employees humanely, free from violence, sexual harassment, physical or mental threats, or verbal abuse, and will maintain standards of hygiene and workplace safety while fostering a positive working environment.
4. The Company communicates and disseminates its policies, provides education and understanding, establishes guidelines, and offers other support to employees, suppliers, and contractors in its business value chain to ensure their participation in conducting business ethically, respecting human rights, and treating everyone according to the principles of human rights outlined in these policies. The Company regularly verifies understanding and provides training on human rights, including non-discrimination and harassment in the workplace, to all employees and relevant parties.
5. The Company shall provide verification processes and channels for employees to file grievances or offer suggestions, as well as report human rights violations related to the business operations of the Company, its subsidiaries, and/or its supply chain. These channels include the complaint channel on the Company’s website (www.asimar.com), email, postal mail, or the Human Resources Department in order to appropriately mitigate or remedy human rights impacts. The identity and personal information of complainants will not be disclosed under any circumstances, unless disclosure is required by law.
6. Violators of human rights are considered a breach of the Company’s code of conduct and will be subject to disciplinary action.
7. The Company is committed to fostering and maintaining an organizational culture that respects human rights, in line with this Human Rights Policies.
8. Child Labor: The Company will comply with laws regarding the minimum employment age and will not allow minor workers to engage in work that is harmful to their health and development, including work that interferes with compulsory education. It will not support or engage with business partners who employ workers below the legal age limit.
9. Forced Labor: The Company will not engage in or support the use of forced labor in any form, and will not demand money from employees or confiscate their identification documents except where required by law.
10. Non-Discrimination: The Company respects diversity and treats all employees equally, without providing unfair advantages or depriving anyone of their rights based on race, nationality, ethnic origin, skin color, lineage, religion, social standing, gender, age, disability, political beliefs, or marital status. Furthermore, the Company will implement measures to prevent and address sexual harassment.
11. The Company is committed to promoting local employment and creating equal opportunities for women in the workplace, fostering a society of equality at work and promoting sustainable development through support for the human rights of everyone in the communities where it operates.
12. Freedom of Association and Collective Bargaining: The Company respects employees’ rights to associate or form groups of any kind that do not violate the law, including their participation in collective bargaining procedures as provided by law.
13. Labor Protection of Pregnant Employees: The Company will provide pregnant employees with a safe working environment at appropriate times and in a manner that does not endanger their pregnancy. The Company will not terminate, demote, or reduce the benefits of employees because of their pregnancy. Regarding, Discipline and Disciplinary Action, the Company will not use inappropriate verbal reprimands or physical punishment, nor will it coerce, threaten, or physical abuse against employees.
In cases where international standards the Company follows or customer requirements are more stringent than the above guidelines, those standards or requirements will be considered and adopted as relevant guidelines where appropriate.
